A firm protested an Army contact award for a headwaters project under a small business set-aside. The firm contended that, because of improper actions by the contracting officer, it was unable to file a size-status protest against the awardee before award. The Small Business Administration (SBA) examined the protester's allegations and concluded that the awardee was a small business concern. GAO does not question SBA actions regarding the size status of small businesses unless there is a showing of fraud or bad faith by SBA, which were not shown in this case. Accordingly, the protest was dismissed.
