A firm protested an Army contracting officer's rejection of its bid under a solicitation for a diagnostic ultrasound system. The protester originally protested the rejection to the contracting agency and this protest was denied. Bid protest procedures provide that, when a protest is filed initially with the contracting agency, subsequent protests to GAO must be filed within 10 working days from notification or constructive knowledge of adverse agency action on the protest. Since this protest was not filed within this timeframe, it was untimely. Accordingly, the protest was dismissed.
