[Protest of HUD Contract Award]

A firm protested the award of a contract to provide liability insurance under an invitation for bids issued by the Department of Housing and Urban Development (HUD). The protester contended that the protester's bid was defective. The procurement was conducted under the authority of the National Housing Act which authorizes HUD to make such expenditures for property maintenance or improvement without regard to any other provision of law governing the expenditure of public funds. Therefore, GAO has no legal basis to question the expenditure of funds under this provision. Accordingly, the protest was dismissed.
