The Department of Health and Human Services (HHS) requested a decision concerning a former employee's entitlement to severance pay. The issue presented was whether an employee who gives notice of his intent to resign after receiving a general notice that the organization which employs him will be transferred to a different location, but whose resignation is not effective until after the transfer had been canceled, is entitled to severance pay. GAO stated that, once the general notice was canceled, the employee could have withdrawn his resignation and remained in his position with the organization. The option to remain in the same position rendered his subsequent separation a voluntary one and precluded payment of severance pay. Accordingly, the employee's claim was denied.
