A firm protested a Veterans Administration (VA) contract award for the installation of sun screens, contending that the contracting officer improperly accepted the awardee's late bid. The awardee's bid was sent via the Postal Service and was delivered during nonbusiness hours, but it was rejected by the security guard on duty. When the delivery was made during normal business hours several days later, the closing time had passed. However, GAO concurred with the contracting officer that the security guard's refusal to accept the bid during nonbusiness hours constituted mishandling by the Government. Further, the procedures established by VA for the receipt of bids during nonbusiness hours were not followed by the security guard. GAO concluded that, had those procedures been followed, the awardee's offer would have been received prior to bid opening. Accordingly, the protest was denied.
