An individual filed a protest with GAO and requested an investigation of the Army's denial of his solicitation protest. The Army informally advised GAO that the initial protest was against a decision made in accordance with Office of Management and Budget (OMB) Circular No. A-76. GAO held that an agency denial of a protest against a determination under the OMB Circular No. A-76 to contract for services rather than have them performed in-house is a matter of executive branch policy not reviewable as a bid protest, nor as a request for investigation when filed by an attorney representing employees and taxpayers. Accordingly, the protest and request for investigation were dismissed.
