A firm requested reconsideration of a decision which rejected as untimely its protest of the Defense Logistics Agency's (DLA) rejection of its bid. In this request, the firm contended that it sent a TWX message to DLA, which represented a timely protest to that agency. However, GAO viewed the TWX message as no more than a notice of intent to file a protest with GAO. In addition, the protester contended that the delay in filing its protest was excused by its need to consult counsel and further that its protest presented a significant issue. GAO stated that consultation with counsel is not a valid basis to extend the filing time for a protest and that issues which have been considered in previous decisions are not "significant" within the meaning of bid protest procedures. Accordingly, the prior decision was affirmed.
