A firm protested the intended award of a Navy contract, asserting that the proposed awardee's product did not comply with certain requirements contained in the solicitation and that the awardee's bid should therefore have been rejected as nonresponsive. GAO found that the protest related to the proposed awardee's responsibility as a prospective contractor. GAO does not review protests of affirmative determinations of responsibility unless fraud on the part of procuring officials is alleged, or the solicitation contains definitive responsibility criteria which allegedly have been misapplied. Since neither exception was applicable in this case, the protest was dismissed.
