[Protest of Alleged Improprieties in Solicitation]

A firm protested the award of an Army contract to the apparent low bidder for janitorial services. The protester contended that: (1) the solicitation specifications were deficient because they provided erroneous measurements; and (2) the solicitation was not set aside for small business concerns. Bid protest procedures require that protests alleging solicitation improprieties which were apparent prior to the closing date for receipt of bids must be filed prior to that date. GAO held that, in this case, the alleged improprieties should have been apparent prior to the bid closing date and, since the protest was filed after that date, it was untimely and not for consideration. Accordingly, the protest was dismissed.
