A firm protested the Navy's award of a contract to an allegedly large business under a small purchase procedure. The protester requested an opportunity to bid on the requirement 1 month after the Navy had awarded the contract. The contracting officer telephoned the protester 2 days after receiving its request and informed it that an award had already been made. Approximately 6 weeks later, the firm filed a protest with GAO. Bid protest procedures require that a protest be filed within 10 working days of initial adverse agency action. Since the protest was not filed within the proper timeframe, it was untimely and not for consideration. Accordingly, the protest was dismissed.
