An individual protested the award of contracts under a request for proposals (RFP) issued by the Army for teaching classes in English as a second language. The protester alleged that there were deficiencies in the solicitation concerned with the contractor's qualifications, performance,and certification requirements. Additionally, the protester alleged that a former employee of the Army should be prevented from bidding on the RFP. However, since the agency stated that the protester did not bid on the RFP, the protest on this matter was academic. A protest of defects in a solicitation, filed after the closing date for receipt of initial proposals and more than 10 days after the initial adverse agency action, is untimely. Accordingly, the protest was dismissed, in part as untimely and in part as academic.
