[Protest Against Warranty Evaluation Factor in Solicitation]

A firm protested the proposed award of a Federal Aviation Administration contract for cathode ray tube assemblies under an invitation for bids (IFB). The protester charged that the evaluation scheme in the IFB was improper because it required that the actual offered price be reduced for evaluation purposes by a certain factor for each hour the offered warranty exceeded 2,000 hours. GAO held that: (1) the warranty factor was apparent in the solicitation, and (2) protests against the solicitation specifications must be filed prior to bid opening. Since this protest was filed after bid opening, it was untimely and was dismissed.
