A firm protested the Air Force sole-source procurement of film inspection devices. The protester asserted that a sole-source procurement was not justified because it also manufactured film inspection equipment and was thus eligible for award. The protester also contended that the agency's refusal to consider its late offer was improper. However, the protest concerning the sole-source justification was found to be untimely, since it was not filed prior to the closing date for the receipt of proposals as required by bid protest procedures. GAO held that the late proposal was properly rejected where the proposal did not meet any of the circumstances listed in the request for proposals for the consideration of late offers. Accordingly, the protest was dismissed in part and denied in part.
