A firm requested remission of funds that had been withheld under a construction contract for the purpose of covering alleged wage underpayments. The requester stated that the contract was governed by the Davis-Bacon wage requirements. However, the contracting agency was a local housing authority that received Federal assistance, and the requester's contract was with that agency, not the Federal Government, despite the fact that the agency was federally assisted. Therefore, GAO determined that the enforcement provisions of the Davis-Bacon Act which GAO is required to administer did not apply to the contract in question. Accordingly, it had no authority to take any action on the request.
