A firm filed a complaint concerning the award of a contract by the city of Riverside, California. The firm, the apparent low bidder, contended that the city improperly rescinded the award because the California Department of Transportation refused to release funds designated for the contract. GAO was advised that the protester had filed suit in the Superior Court of California seeking injunctive relief to require release of the funds and reinstatement of the award. Further, the court had not expressed an interest in receiving a GAO decision on the matter. It is GAO policy not to consider complaints where the material issues are pending in a court of competent jurisdiction unless the court requests, expects, or otherwise expresses an interest in receiving its views. Therefore, the complaint was dismissed.
