Protest of Proposal Rejection

A firm protested the rejection of its proposal as late, asserting that its proposal was delivered in a timely fashion to the mailroom of the facility in question, and its late receipt in the room specified in the request for proposals (RFP) was due to Government mishandling. Since an exception provision in the RFP referring to Government mishandling applied only to proposals that were submitted by mail, and the protester's proposal was submitted through a commercial carrier, GAO held that consideration of the proposal would not be permissible and that rejection of the proposal was proper. Accordingly, the protest was denied.
