A firm protested the refusal of Army contracting personnel to comply with the Defense Acquisition Regulation which it asserted requires solicitations to be synopsized in the Commerce Business Daily (CBD) for 20 days prior to award. However, in effect, the firm protested the award of several contracts shortly after the CBD synopses were published. Bid protest procedures require that a protest be filed within 10 working days after the basis of the protest is known. From the information submitted with the protest, it was apparent that the protester knew of the initial CBD synopsis and award and that the protester was also aware of the CBD synopses and awards for the additional equipment. GAO did not receive the protest until approximately 20 days after the basis of the protest was known. Therefore, the protest was untimely filed and was not considered on its merits. Accordingly, the protest was dismissed.
