Protest of Air Force Contract Award

A firm protested the award of a contract under a request for proposals issued by the Air Force. The protester alleged that several deficiencies occurred during the negotiation process. The protester complained that no negotiations were conducted with it and that no best and final offer was requested. The Air Force contended that the protest should have been dismissed as being untimely filed under bid protest procedures. Bid protest procedures require that protests must be received by the contracting agency or GAO not later than 10 working days after the basis of the protest is known or should have been known. The protest was not filed until almost 1 month after the basis of the protest was known; therefore, it was untimely and was not considered on the merits. Accordingly, the protest was dismissed.
