Request for Reconsideration for Waiver of Overpayments

A civilian employee of the Army requested reconsideration of the prior settlement by the Claims Group concerning his request for waiver of erroneous payments of living quarters allowance. Through administrative error, the employee received excess foreign living quarters allowances. Because of changes in dollar values, the amounts of the allowance payments differed with each pay period. However, certain of the payments were large enough that any reasonable person would have been aware that a mistake had been made. Since the employee did not try to correct this mistake, he was at fault, and those amounts could not be waived. The smaller amounts that were difficult to identify as overpayments could be waived. Accordingly, the prior settlement was modified to reflect these changes.
