A firm protested the award of a contract for the preparation of a wastewater plant issued by the Northwest Bergen County Sewer Authority (NBCSA) in New Jersey under a grant administered by the Environmental Protection Agency. The protester argued that it should have been selected because its technical proposal was initially ranked first, and its price was lowest. It also contended that negotiations were improperly conducted. Three municipalities served by NBCSA have filed suit in the Superior Court of New Jersey to set aside the contract to the awardee in favor of award to the protester. It is not GAO policy to review matters where the naterial issues are before a court of competent jusrisdiction unless the court expresses an interest in receiving the GAO views. Since the Court has not expressed interest in the opinion of GAO, the protest was dismissed.
