Protest Involving Contract Administration

A firm previously protested the award of a Defense Logistics Agency (DLA) contract, contending that the awardee did not intend to furnish parts in compliance with the contract requirements. GAO held that whether an awardee performs in accordance with the contract requirements is a matter of contract administration which is the responsibility of the contracting agency. That protest was dismissed. Subsequently, the protester advised GAO that the awardee never placed a purchase order for parts as required in the contract specifications and requested that GAO require DLA to rescind the contract. GAO again held that contract compliance is a matter of contract administration for agency determination. Thus the previous decision dismissing the protest was sustained.
