A company protested the sole-source award of a consultant contract. The company claimed that it had previously contacted the procuring agency concerning the award of a contract to pursue goals identical to those of the protested contract. The protest alleged that, despite the agency's knowledge of the company's expressed interest and qualifications, it purposefully excluded the protester from consideration for the contract and did not publish any notice of its intent to solicit for the services prior to making the award. Because the protest was filed more than 10 days after the basis for protest was known, it was untimely. Accordingly, the protest was dismissed.
