Protest of Contract Termination for Default

A firm protested the termination its contract for default by the Department of the Air Force. The protester contended that its failure to comply with the terms of the contract was due in large measure to acts and failures on the part of the Government and that the termination was unwarranted. GAO held that the question of whether a contract should be terminated for default is a matter of contract administration and is for consideration under the procedures set forth in the disputes clause of the contract, not GAO Bid Protest Procedures. Accordingly, GAO declined to consider the protest on its merits.
