Protest of Bid Rejection as Nonresponsive

A firm protested the determination that its bid under an invitation for bids by the General Services Administration (GSA) was nonresponsive, the subsequent rejection of the bid, and the award of the contract to another bidder. Although GSA determined after the award of the contract that the firm's bid was actually responsive, the firm was found to be nonresponsible. Moreover, GSA advised the firm that it would send the matter to the Small Business Administration for the possible issuance of a certificate of competency (COC). Since the law provides that COC determinations are final, GAO does not ordinarily review COC determinations. Accordingly, the protest was dismissed.
