A firm protested the award of a contract alleging that the bid specifications contained deficiencies. The protest was originally filed with the agency, but the agency opened bids as scheduled without satisfying all of the protester's concerns. When a protest is initially filed with an agency, any subsequent protest to GAO must be filed within 10 days of the protester's knowledge of initial adverse agency action on its protest. The opening of bids without the requested modification of the solicitation constituted adverse agency action. The protest to GAO was not received until more than a month after the opening of bids. Therefore it was untimely and dismissed.
