Protest Involving Solicitation Cancellation

A company protested the award of a contract for reconditioning apartments with the Department of Housing and Urban Development (HUD), complaining of the cancellation of an earlier solicitation under which it was the low bidder, and the subsequent award at a price only slightly lower than its previous price. The protest was not considered since the Secretary of HUD has broad statutory authority to make expenditures as needed for maintenance and improvement of property, and there was no legal basis to question this expenditure. Accordingly, the protest was dismissed.
