A firm protested the termination of negotiations with respect to the proposed award of a contract for architect-engineer services. On August 22, 1979, after being advised that its proposals and price were substantially inconsistent with the procuring agency's requirements, the firm filed a protest with the procuring agency. The procuring agency responded to the protest by letter of October 17, giving a detailed explanation of its position. On December 3, the firm filed its protest with GAO. If a protest has been filed initially with the contracting agency, any subsequent protest to GAO must be filed within 10 working days after notification of initial adverse agency action. Since it was apparent that the protest was not filed within that period, it was dismissed.
