After two firms protested the award of a Navy contract, one of them filed suit in the United States District Court for the District of Columbia seeking declaratory and injunctive relief. Because this matter was in litigation, and a final court action would take precedence over any action by GAO, GAO would not consider it unless the court requested its decision. The protests were dismissed.
