Request for Retroactive Salary Increase

An administrative error caused an employee of the Department of Justice to be appointed to a position at grade GS-13, step one, rather than GS-13, step two as the Department intended. The employee requested a retroactive appointment and salary increase to the step two level, and in some cases GAO has permitted adjustments. However, in this case, the agency failed to obtain prior approval from the Civil Service Commission which is required when appointing an employee to a position of GS-grade 11 or above at a rate that is above the minimum rate of the appropriate grade. Therefore, the retroactive appointment salary increase was not allowed.
