Protest Alleging That Agency Did Not Use Most Current FSS Prices

A corporation protested the issuance by the Federal Bureau of Investigation (FBI) of a delivery order to a competitor for dictation equipment. The protester asserted that at the time the order was issued it was the lowest cost supplier under the Federal Supply Schedule (FSS) contract for dictation equipment that would meet the needs of the FBI. The protester also contended that the competitor's units purchased were not in current production. The record indicated that the protester's units were originally listed on the FSS at $489 each, but by letter the protester reduced the unit price to $465. However, the FSS data reviewed by the FBI did not reflect the price reduction. It is the responsibility of the supplier of an item listed on the FSS to notify contracting activities of price reduction. Contracting activity is not required to contact the General Services Administration (GSA) or the supplier to verify the listed price. An item offered to GSA for listing on the FSS must be a new and current model at the time of offer, but not necessarily in current production. There was no merit to the protest. The protest was denied.
