A company protested any award under a solicitation by the Defense Logistics Agency (DLA) on the basis that DLA did not solicit a bid from the protester, the incumbent contractor. The protester asked that the solicitation be canceled and reissued. There were no allegations of an intentional attempt by DLA to preclude the protester from competing in this procurement. The failure of the protester to receive a bid package was not the result of a deliberate or conscious attempt by DLA to prevent it from bidding on the contract. Therefore, the omission of the incumbent contractor from the procurement did not require a resolicitation. The protest was denied.
