A response was requested by the Internal Revenue Service regarding a claim for reimbursement of certain expenses incurred by a Federal mining engineer incident to his move to his first post of duty. Although the appointee was given incorrect information regarding his entitlements, and his written authorization for moving expenses reflected that information, his claim was denied since regulations specifically prohibited payment of the allowances claimed. The United States is not liable for the erroneous actions of its officers, agents or employees, even though committed in the performance of their official duties.
