An employee of the Department of Health, Education and Welfare (HEW) appealed the denial of a claim for retroactive temporary promotion and backpay. The employee's claim involved two separate and distinct personnel actions. The claimant, who was a permanent GS-14, alleged that she was detailed to a GS-15 position as Acting Chief and later was detailed to another position at GS-15. The claim under the Acting Chief position was initially denied by the agency because the position to which she was detailed had been officially abolished due to agency reorganization. Likewise, the claimant was not entitled to temporary promotion and backpay in connection with the second detail since the employee did not serve the 120-day period necessary for a temporary promotion with backpay. Accordingly, the disallowance of the employee's claim was affirmed.
