A bidder protested that an invitation for bids (IFB) issued by the Marine Corps contained restrictive and unreasonable requirements. The protest was filed with the Marine Corps in the bid package, and was filed with GAO the day following bid opening. Bid Protest Procedures require that protests based on alleged patent solicitation defects, such as restrictive specifications, be filed with GAO or the contracting agency prior to bid opening. Therefore, the protest was dismissed as untimely.
