A Marine Corps member who received a retroactive promotion subsequently married and moved his dependent wife to his duty station. The member then requested overseas housing and cost-of-living allowances. When the member first arrived at his duty station, he was single and not able to opt for an accompanied tour of duty. The member was ineligible for a housing allowance at the beginning of his tour and, under regulations in effect at the beginning of his tour, was ineligible for overseas housing and cost-of-living allowances for the remainder of that tour. A revision in the regulations which now permits payment of the allowances may not be applied retroactively. The claim was denied.
