The Army requested modification of the recommendation set forth by GAO regarding the termination of a contract improperly awarded for dictating and transcribing (D/T) equipment at Walson Army Hospital. According to the Army, disruption of the central D/T system will seriously interfere with the hospital's operations. The Army proposed that they purchase the installed D/T equipment rather than remove the equipment and use leased equipment until a new contract can be awarded. In determining whether an improper award should be terminated, certain factors must be considered including the seriousness of the procurement deficiency, the degree of prejudice to other bidders/offerors or the integrity of the competitive procurement system, the good faith of the parties, the extent of contract performance, the cost to the Government, the urgency of the procurement, and the impact on the procuring activity's mission. The use of rented individual D/T units would, at most, produce a minor, short-term administrative inconvenience. This inconvenience is not viewed as sufficient reason to reverse the recommendation that the improperly awarded contract be terminated.
