Under federal law, federal agencies must comply with state regulations governing the discharge of dredged material into navigable waters, as private persons do, and must get permits to do so if required by the state. The Forest Service construction of a wildlife flowage by impounding a stream in Wisconsin will result in dredged material flowing into a creek. Since Wisconsin law governing dredging does not require a permit of anyone discharging dredged material, the permit is not required and the fee may not be paid.
