Following the commencement of garnishment of his wages to repay money lost while in his possession, a Federal employee filed suit to enjoin the agency from continuing the practice. The defendants moved for dismissal or summary judgement, arguing that the employee had an adequate remedy under the law of requiring the United States to sue. After a dismissal order had been entered, the employee requested that GAO make a statutory report. Since a balance of over $1600 remains due, the Government may now begin suit to adjudicate the matter.
