A company protested the agency's decision to waive first article testing for the immediate past producer of the solicited item, contending that the specifications modified the test sets to such a degree that first article testing should be required of all bidders. The procuring agency has the responsibility for determining if first article testing is necessary and may waive the requirement. Such a waiver does not constitute preferential treatment nor create an unfair advantage for the prior producer.
