A physician appealed the denial of his claim for payment of transportation expenses, shipment of household goods, and a lump-sum payment for unused leave incident to his separation from active duty with the Commissioned Corps of the Public Health Service. The denial was sustained. An existing variable incentive pay (VIP) agreement may not be renegotiated to a lesser commitment by executing a second VIP contract. The officer who did not complete the agreed-upon service was subject to refund provisions and may be divested of entitlement to lump-sum annual leave and travel and transportation entitlements.
