An incumbent contractor protested the agency's delay in awarding a contract for continuing services, alleging that the low bidder did not hold a valid license as required by the solicitation. Since the requirement for a license involves a State requirement, the contracting officer properly included it in the solicitation. If the low bidder is otherwise responsive and responsible and can obtain a license in a reasonable time, it may obtain the award without already holding the license. The solicitation's requirement for compliance with the Anti-Pinkerton Act was unnecessary.
