A company protested a contract award, contending that the prime contractor reopened negotiations with the awardee after receipt of the best and final offers. The contractor is required to award subcontracts on the basis of fair and equal treatment of all competitors, but the protester was not treated equally because the contract did not permit it to submit a price after receipt of best and final offers. The protest was sustained, but a request for termination of the contract was inappropriate. Recompetition would not be in the best interest of the Government.
