An advance decision was requested as to the propriety of charging National Oceanic and Atmospheric Administration (NOAA) appropriated funds with payment of a fine levied by a local agency for the NOAA violation of local air quality standards. NOAA must comply with these standards and is subject to sanctions imposed by the local authority since provisions of the Clean Air Act waived the defense of sovereign immunity. The penalty may be paid from appropriations for necessary expenses.
