An opinion was requested as to whether a letter from the Air Force's Chief of Industrial Resources to the General Services Administration (GSA) had the legal effect of divesting the Secretary of the Air Force of his authority to lease certain property. The letter, which stated that certain government-owned property can be considered excess if a sale can be arranged, did not prohibit the lease of the property because the letter did not constitute a final determination that the property was excess, and GSA knew that leasing was under consideration and did not voice objections.
