An employee appealed a settlement disallowing his claim for a retroactive promotion and backpay, alleging that other employees were granted waivers of the time-in-grade requirement and that waivers were granted or denied in an arbitrary manner. He also alleged that agency policies on this issue were never published and made available to employees and that his position was improperly classified. GAO does not determine whether a position is properly classified or described. There is no authority under which backpay may be allowed.
