The protesters asserted that the low bidder was improperly permitted to modify its proposal after receipt of the best and final offers. This issue need not be resolved since for other reasons the agency should have clarified its requirements and reopened negotiations with all offerors. This would have provided the contractor an opportunity to cure its mistake. The major deficiency disclosed was the agency's failure to clarify its requirements and to request a second round of best and final offers. If it had done so, there is no assurance that the award would not have gone to the present contractor. Although the protests were sustained, termination of the existing contract was not in the best interest of the Government.
