A provision in an invitation for bids which requires bidder to indicate its "ICC Operators Authority" is a definitive criterion of responsibility, compliance with which is subject to GAO review. A recent ICC decision required the bidder to have Operators Authority in its own name. The contracting officer should determine if the low bidder can meet that requirement in view of its corporate arrangement.
