A decision was requested as to whether the IRS may retroactively adjust the promotion of 21 career ladder employees in the Jacksonville, Florida, District Office. Since the employees had no vested right to be promoted under statute, regulation, or collective bargaining agreement, delay of promotion was not improper and corrective action under the Back Pay Statute was authorized.
