The protester alleged that auction techniques were used by the agency under a request for proposals. The procurement involved the purchase of domestic supplies by the agency on behalf of a foreign government pursuant to section 22(a) of the Foreign Military Sales Act. Since the purchase would not involve the spending of appropriated funds, it was not subject to GAO settlement authority, and the protest was dismissed.
