Protest Against Rejection of Best and Final Offer as Nonresponsive

The protester objected to the agency's determination that the lower-priced option contained in its best and final offer was of questionable compliance with the request for proposals. The response to the request for best and final offers was reasonably interpreted by the agency as being of questionable compliance with the request for proposals and was properly rejected without first obtaining clarification from the offerer since the burden was on the offerer to affirmatively demonstrate the merits of the proposal.
